Agreement
By accessing bymyth.com, creating an account, or purchasing a Mȳth product, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our products or services.
These Terms constitute the entire agreement between you and Mȳth Health LLC regarding your use of our products and services, superseding any prior agreements.
Products and Services
Mȳth offers the Recovery Sensor hardware as a one-time purchase, a replacement adhesive pad subscription at $9.99 per month, and the Mȳth mobile application for iOS. Access to premium app features requires an active subscription.
We reserve the right to modify, suspend, or discontinue any feature of the app with reasonable notice. We will not reduce core measurement functionality without offering affected users a pro-rated refund for any remaining prepaid subscription period.
App License
We grant you a personal, non-transferable, non-exclusive, revocable license to use the Mȳth application on devices you own or control. You may not copy, modify, distribute, reverse engineer, or create derivative works from any part of the Mȳth software.
Subscriptions
The $9.99 per month subscription renews automatically each month until cancelled. You may cancel at any time through the app or by emailing support@bymyth.com. Cancellation takes effect at the end of the current billing period — you retain access and receive your final pad shipment through that date. No partial-month refunds are issued on subscription fees.
Account Responsibilities
You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account. We may suspend or terminate accounts involved in fraud, misuse, or violation of these Terms.
Health Disclaimer
Mȳth is not a medical device. The session cost score, HRV readings, and recovery guidance are for informational and personal wellness purposes only. They are not intended to diagnose, treat, cure, or prevent any medical condition. Always consult a qualified healthcare provider before making changes to your training, nutrition, or supplementation based on any data from Mȳth.
HRV measurements from the Mȳth sensor are validated for wellness and training optimization purposes. They are not equivalent to clinical-grade medical measurements. If you experience chest pain, unusual heart rhythms, or other medical symptoms, seek medical attention immediately — do not rely on Mȳth data for medical decision-making.
Limitation of Liability
To the fullest extent permitted by applicable law, Mȳth Health LLC's total liability arising from your use of Mȳth products or services shall not exceed the amount you paid for the specific product or service giving rise to the claim in the 12 months preceding the claim.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or data, even if advised of the possibility of such damages.
Some jurisdictions do not allow limitation of certain warranties or damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
Intellectual Property
All content on bymyth.com, the Mȳth app, and associated materials — including the Mȳth name, wordmark, session cost score methodology, and app interface — are owned by Mȳth Health LLC. Nothing in these Terms grants you ownership of any intellectual property.
Governing Law and Disputes
These Terms are governed by the laws of the State of Arkansas, without regard to conflict of law provisions. Any dispute arising from these Terms or your use of Mȳth products shall first be addressed by contacting support@bymyth.com. If the dispute cannot be resolved informally within 30 days, it shall be submitted to binding arbitration under the American Arbitration Association Consumer Arbitration Rules. By agreeing to these Terms, you waive the right to participate in a class action lawsuit or class-wide arbitration.
Nothing in this clause prevents either party from seeking injunctive or other equitable relief for intellectual property infringement.
Changes to Terms
We may update these Terms at any time. We will notify you via email and a notice on bymyth.com at least 14 days before material changes take effect. Your continued use after the effective date constitutes acceptance.
